Introduction
These Terms and Conditions (“Terms”) apply to the Fortune & Favour “Luxury Holiday” prize draw (the “Competition”). The Competition is a skill-based prize draw operated by Fortune & Favour (the “Promoter”) from Scotland, United Kingdom. By entering, you (“Entrant”) agree to be bound by these Terms. Please read them carefully. This promotion is not affiliated with or sponsored by Instagram or any other social platform.
Eligibility
To enter the Competition, you must meet all of the following eligibility criteria:
• Age: You must be 18 years of age or older at the time of entry.
• Residency: You must be a resident of the United Kingdom (including Scotland, England, Wales, and Northern Ireland).
• Personal Eligibility: The Competition is open to individuals only (not companies or agencies). Employees, agents, or partners of Fortune & Favour, Beyond Bond Hair, or any of their immediate family or household members are not eligible to enter.
• Travel Capability: You must hold a valid passport and be able to travel to the prize location if you win. It is your responsibility to obtain any required travel documents (e.g. passports, visas).
The Promoter reserves the right to verify your eligibility at any stage. Entrants may be required to provide proof of age, identity, and residency (such as a passport or driving licence). Invalid or ineligible entries will be disqualified.
Entry Method
To enter the Competition via our website / online, you must complete all of the following steps during the promotion period:
1. Purchase an Entry: Visit the Fortune & Favour competition website and purchase a ticket for the “Luxury getaway” prize draw (each entry costs £5.00). Entrants may purchase multiple entries (subject to availability and any per-person limits specified by the Promoter).
2. Answer the Skill Question: During the entry process, you will be presented with a competition question. Submit your answer to this question. Only entries with the correct answer will qualify (see Skill Requirement below).
3. Provide Contact Details: Provide a valid email address and any other requested contact information at the time of entry. This is so we can reach you if you win.
All entry steps (payment, answering the question, and Instagram actions) must be completed before the competition closing date. Entries that do not complete all steps, or that are received after the announced closing deadline, will be invalid. The Promoter will not be responsible for entries that are lost, delayed, incomplete, or not received due to technical issues or any reason beyond our control.
To enter the Competition via post, you must send your full name, address, telephone number, email address and the correct answer to the following question - "Which country is Venice located in?" - on a plain postcard or sealed envelope to: Fortune&Favour Competitions, 66 Henderson Row, Edinburgh, EH3 5BJ.
Postal entries must be received by Fortune and Favour prior to the competition closing date/time to be counted as a valid entry. Incomplete or illegible entries will not be accepted. All valid entries received by post will be treated exactly the same as paid entries and entered into the draw on an equal footing.
Skill Requirement
This Competition is a skill-based prize competition under UK law. To ensure compliance and fairness, each entrant must successfully answer a question:
• Upon entering, you will be asked a specific question (e.g. a general knowledge or puzzle question). You must select or provide the correct answer to qualify for the prize draw.
• Only entries with the correct answer to the skill question will be entered into the winner selection draw. If you answer the question incorrectly, your entry will not be eligible to win the prize.
• Entry Fee is Non-Refundable: If your answer is incorrect, you will not be entered into the draw and will not receive a refund of the entry fee. The entry fee covers the opportunity to answer the skill question and participate; it is the entrant’s responsibility to answer correctly.
• The correct answer will be determined by the Promoter (the answer is objective and known in advance). The Promoter’s decision on the correctness of answers is final and no correspondence will be entered into regarding any answers.
By entering, you acknowledge that this Competition is based on skill and not purely chance. The skill requirement is intended to ensure a significant degree of knowledge or skill is needed to win.
Prize Details and Exclusions
Prize: The winner of the “Beyond Bond” Competition will receive a holiday for two in summer 2026 and a Beyond Bond hair makeover, as described below:
A professional hair makeover consisting of a full head of hair extensions (if desired) provided by Beyond Bond Hair (the Competition’s collaborating partner). This service will be performed by Beyond Bond Hair’s stylists at their salon (located in Edinburgh, Scotland) or an associated venue as determined by Beyond Bond Hair, on a date to be scheduled with the winner, subject to appointment availability.
A holiday for two people to one of two destinations / hotels provided as options at the discretion of Fortune and Favour based on the budget assigned for this prize at the date of purchase.
The winner can elect to exchange the holiday for £1000 cash and may gift the makeover experience if they choose to. The makeover experience is not exchangeable for a cash alternative.
Prize Exclusions: The prize does NOT include any costs or expenses other than those explicitly stated. The following are excluded and are the sole responsibility of the winner:
• Travel and Transport: The prize does not include the cost of travel to and from the airport. It also does not include local transportation whilst on holiday or any travel to the makeover destination.
• Meals and Incidentals: No meals, drinks, or catering are provided as part of the prize unless explicitly detailed in the final prize being offered. The winner (and guest) will be responsible for all food, beverages, and personal expenses during their stay. Additionally, any other personal expenses, gratuities, or incidental costs (such as travel insurance, leisure activities, or souvenirs) are not included.
• Additional Services: Any additional services or upgrades (e.g. extra nights) or additional hair services beyond the full-head extensions (e.g. future maintenance, styling beyond the initial service) are not included in the prize. If offered, such extras would be at the winner’s discretion and expense.
Prize Conditions:
• The exact date of the holiday chosed will be arranged between the winner and the competition hosts. Blackout dates or peak-season restrictions may apply (for example, certain holidays or high-demand periods might be unavailable). The winner should provide several preferred dates for the trip and must take the holiday on a date within 12 months of being announced as the winner, unless otherwise agreed by the Promoter. If the winner is unable to travel within 12 months, the prize may be forfeited (subject to Promoter’s discretion).
• The hair extension service must be booked in advance with Beyond Bond Hair. The winner should redeem the hair extension portion of the prize within 12 months of winner announcement, subject to scheduling availability with the stylists at Beyond Bond Hair’s salon. Consultation may be required to determine suitable hair extensions and or other services. The winner is responsible for any care or maintenance of the hair extensions and any other beauty or hair services received after the initial service.
• Guest Policy: The winner may bring one guest (age 18 or above) on the holiday experience of their choosing.
• No Cash Transfer by Winner: The prize is non-transferable by the winner. It cannot be sold, assigned, or given to someone else. If you are the winner, you must claim the prize yourself (though you can choose a guest for the holiday). The hair extension service portion cannot be exchanged for cash but a gift voucher for the makeover can be created at the request of the winner should they wish to gift it to someone.
• Prize Provider Terms: The luxury holiday experience will be arranged through approved travel partners and is subject to their standard booking terms and conditions (including but not limited to flight regulations, accommodation policies, and any local requirements such as passport validity or travel insurance). The makeover experience will be provided by Beyond Bond Hair and is subject to Beyond Bond’s usual booking, consultation, and consent policies for hair and scalp treatments. The Beyond Bond team will make reasonable efforts to travel to a major UK city convenient to the winner to fulfil the service. If the winner chooses the cash alternative, payment will be made via bank transfer within 30 days of prize acceptance. The promoter and prize providers will make all reasonable efforts to schedule and fulfil the prize but reserve the right to modify or reschedule in the event of factors beyond their control (for example: travel restrictions, illness, or extreme weather). No compensation will be offered for delays beyond reasonable re-scheduling.
• Availability & Force Majeure: The fulfilment of the prize is subject to availability and to factors outside the Promoter’s control (such as weather conditions, travel restrictions, or other force majeure events). The Promoter and prize providers will make reasonable efforts to schedule and fulfil the prize, but reserve the right to reschedule or modify the experience in case of events beyond their control (e.g. severe weather might delay an element of the trip). No compensation will be offered for such delays beyond re-scheduling the prize when feasible.
By accepting the prize, the winner agrees to these prize conditions. The Promoter will provide the winner with instructions on how to book the trip and the hair makeover appointment after winner verification.
Ticket Sales Threshold
Fortune & Favour aims to award the advertised prize; however, the Competition is subject to a minimum number of entries being sold (the “Minimum Ticket Sales Threshold”) to make the promotion viable. The Promoter reserves the right to modify or cancel the Competition if insufficient entries are received, as follows:
• Minimum Threshold: The Promoter may establish a minimum number of paid entries that must be sold by the closing date for the main prize to be awarded as described. This number (if applicable) will be determined by the Promoter and may be communicated on the Competition page. If the Competition closes and the number of valid entries is below this threshold, the Promoter can take one or more of the actions outlined below.
• Extension of Entry Period: The Promoter may choose to extend the Competition’s closing date to allow more entries to be sold. Any such extension will be communicated if feasible, via email to existing entrants. The Promoter will not extend the competition unreasonably; any extension will have a new definite closing date. Entrants who entered before the extension will remain eligible (no need to re-enter).
• Prize Substitution or Modification: If the entry count remains insufficient (or if the Promoter elects not to extend the Competition), the Promoter reserves the right to replace or alter the prize. This means the originally advertised prize may not be awarded in full. Instead, the Promoter may offer:
• a cash prize alternative, or
• a different prize of lower or equivalent value,
at the Promoter’s sole discretion. This cash or alternate prize may be of significantly lesser value than the advertised experience. (For example, the Promoter might award a cash sum based on a portion of the entry fees collected, which could be less than the yacht charter’s value.)
• Cancellation and Refund: In extreme cases, the Promoter reserves the right to cancel the Competition entirely if the participation level is far below expectations. If the Competition is canceled without any prize being awarded, the Promoter will refund all paid entry fees in full to entrants (for example, by reversing transactions or via the original payment method, within a reasonable time). No administrative fees will be deducted from such refunds.
The Promoter will make a decision on these steps in good faith, aiming to be fair and transparent. If any change as above is necessary, the Promoter will inform entrants by updating the terms on the website and/or contacting entrants via the email provided at entry. Entrants will not have the right to object to the Promoter’s decision to substitute a prize or offer a cash alternative if the decision is made in accordance with these Terms. By entering, you acknowledge that the advertised prize is contingent on sufficient participation and that you accept the risk that a different prize (potentially a cash amount of lesser value) may be awarded if the threshold is not met.
(Note: The inclusion of this clause is to ensure Fortune & Favour can fulfil its obligations responsibly. The Promoter’s intention is to award the experience if possible; alternative prizes or cash would only be considered if absolutely necessary, such as to avoid an unviable situation.)
Winner Selection
Draw Process: Once the Competition has closed (either on the original closing date or an extended date, if applicable), the Promoter will compile all valid entries. A valid entry is defined as an entry where: (a) the entry fee was paid; (b) the skill question was answered correctly and (c) the entrant meets all necessary requirements including minimum age and UK residency. From all such valid entries, one (1) winner will be selected at random. The winner will be determined by a random draw – this may be conducted through a random number generator or another fair draw method. The draw may be performed in the presence of an independent adjudicator or witness to ensure impartiality.
• The draw will take place as soon as reasonably practicable after the Competition closing time. The exact draw date and time may or may not be announced publicly in advance, but it will typically occur within a few days of competition closure (unless an extension or verification delay occurs).
• Odds of Winning: The odds of winning depend on the total number of valid entries received. (For example, if there are 800 valid entries, your chance of winning with one entry is 1/800.)
• If, for any reason, an entrant’s name is drawn who is later found not to have a valid entry or is disqualified, the Promoter will redraw as needed until a valid winner is identified.
• The Promoter’s decision is final in all matters related to the winner selection. No correspondence or appeals will be entertained regarding the outcome of the draw.
Winner Notification: The Promoter will contact the winner using the contact information provided at entry:
• The initial contact will be made to the winner’s email address (as provided when purchasing the ticket). Fortune & Favour will send a congratulations message with details on how to claim the prize. We may also attempt to reach the winner via any other contact method provided (such as a phone number, if collected).
• The winner will also be announced publicly on Instagram. The Promoter will post an announcement on its official Instagram page (and/or Stories) naming the winner (typically by first name and maybe last initial or Instagram handle). This announcement will occur after direct contact is made (to ensure the winner has been notified). By entering, you consent that if you win, your first name and/or social media handle may be announced on our social media channels.
• Winner Response: The winner must respond to the Promoter’s notification within 14 days of the initial contact. In the response, the winner will be required to confirm eligibility (age, identity, etc.) and arrange acceptance of the prize. We may ask the winner to provide proof of ID and any other details needed to facilitate prize delivery (for example, confirmation of Instagram account, agreement on travel dates, etc.).
If the winner does not respond within 14 days, or is found to be ineligible or disqualified for any reason (e.g. failed to complete the Instagram action, provided false information, etc.), the Promoter reserves the right to disqualify that winner and forfeit their claim to the prize. In such case, an alternate winner will be drawn from the remaining valid entries, and the notification process will be repeated with the new winner. This process (winner draw -> notification -> 14-day response window) will continue until a valid winner properly claims the prize. If no valid winner claims the prize after two redraws, the Promoter may cancel the prize award subject to any guidance from relevant authorities.
The prize will only be awarded after successful winner verification and acceptance of these Terms. Arrangements for the yacht booking and hair appointment will be made directly with the confirmed winner. The winner should not make any travel bookings or commitments related to the prize until they have had confirmation from the Promoter, as the Promoter will not be liable for any costs incurred before such confirmation.
Publicity
By entering this Competition, you agree to participate in reasonable publicity related to the prize if you are the winner. In particular:
• The winner agrees that Fortune & Favour may use their name, general location (e.g. city or county), and any photographs or videos of the winner taken during prize fulfilment (for example, pictures on the yacht or at the hair salon) for promotional purposes. Such usage may include posts on the Promoter’s website, social media accounts (Instagram, Facebook, etc.), press releases, and other marketing materials, solely in connection with promoting the Competition or future Fortune & Favour competitions.
• The winner may be asked (at a mutually convenient time) to take part in promotional activities – for example, providing a short testimonial or review of their experience, or being photographed with the prize. The winner is not obliged to participate in any specific publicity event if it is not reasonable or they are not comfortable, but allowing at least an interview, quote, or photo is appreciated to help verify and publicise the outcome of the Competition.
• No additional compensation will be given for such publicity participation – the prize is deemed sufficient consideration. The winner’s consent for publicity is a condition of accepting the prize; refusal to allow any publicity at all may result in forfeiture of the prize at the Promoter’s discretion (though reasonable accommodations can be discussed, such as using first name only or obscuring identity if warranted).
• For transparency, the winner’s name (and county of residence) may be made available to anyone who requests it from the Promoter (for example, a list of winners request) in accordance with UK advertising regulations. If you object to your information being published or made available, you must inform the Promoter at the time of winning; however, the Promoter may still be obliged to share certain details with regulators or to comply with the law.
All entrants, by participating, agree that if they win, they will not withhold permission for the Promoter to announce them as the winner and use limited personal details for legitimacy and marketing. All non-winning entrants’ names will not be publicise by the Promoter without further consent.
Limitation of Liability
Insofar as is permitted by law, the Promoter, its partners, and agents will not be liable for:
• Non-entry/Disqualification: Any entries that are not properly submitted, lost, misdirected, or disqualified, regardless of cause. This includes, for example, any technical failures (such as website downtime, payment processing errors, or Instagram outages) that result in an entry not being recorded or an Instagram action not being verifiable. It is the entrant’s responsibility to ensure all steps are completed correctly and to contact the Promoter before the closing date if there is an issue.
• Personal Travel and Safety: Any costs, damages, or losses incurred by the winner (or guest) in the course of traveling to take the prize, or during the enjoyment of the prize. The winner and guest undertake the trip and hair treatment / makeover at their own risk. The Promoter is not responsible for any injuries, illness, accidents, or other issues that occur during travel or the prize experiences. The winner is encouraged to obtain travel insurance at their own expense to cover the trip and any unforeseen events.
• Prize Fulfilment by Third Parties: The Promoter shall not be liable if the city break experience or hair any agreed upon services cannot be provided as promised due to actions or omissions of third-party providers.
• Consequential Loss: Any indirect or consequential loss or damage, loss of enjoyment, or disappointment arising from entering the Competition or from accepting/experiencing the prize. While we want every winner to have a fantastic time, the Promoter makes no guarantee that the experience will meet the winner’s expectations, and accepts no additional liability if it does not.
• Instagram and Platform Issues: The Promoter is not responsible for any failure of the Instagram platform, or any other website, that might hinder an entrant’s ability to participate. We also cannot be responsible for changes to Instagram’s functionality or policies that might impact the Competition (though we will adapt if possible). Entrants use Instagram at their own risk and subject to Instagram’s terms of service.
• Entries Voided by Law: If, for any reason, any aspect of the Competition is not capable of running as planned due to law or regulation (for instance, if authorities deem the Competition not compliant), the Promoter reserves the right to void any entries and/or cancel or modify the Competition without liability. In such a case, entry fees may be refunded at the Promoter’s discretion, and no compensation beyond a refund (if applicable) will be due.
The Promoter’s total liability in connection with this Competition, whether in contract, tort, or otherwise, shall be limited to the value of the prize or the entry fee paid by that entrant (whichever is higher), except that nothing in these Terms will limit the Promoter’s liability for death or personal injury caused by the Promoter’s negligence, or for fraud, or any other liability that cannot be excluded by law. Your statutory rights are not affected.
Force Majeure: The Promoter will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations (including awarding or fulfilling the prize) that is caused by events outside its reasonable control, such as strikes, pandemics, war, natural disasters, or any government restrictions.
Data Protection
Your privacy is important. By entering the Competition, you consent to the Promoter collecting, storing, and processing your personal data for the purposes of administering the Competition. Key points about data protection are:
• Data Collected: We will collect personal information such as your name, email address, payment details (handled securely by the payment processor), Instagram username, and any other details you provide when entering. If you win, we may collect additional details needed to arrange the prize (e.g. your phone number, address, passport verification, etc.).
• Use of Data: Your data will be used only for Competition purposes: to verify eligibility, to contact winners, to announce the winner, and to arrange prize fulfilment. If you have opted in to receive marketing emails from Fortune & Favour, we will use your email for that purpose as well – but that is separate from the Competition (and you can unsubscribe at any time).
• Data Sharing: We will not sell or share your personal information with third parties for their own marketing. We may share necessary details with trusted third parties involved in the Competition, for example:
• With the Trip - Your name, contact details and passport details will be required to book travel and hotels.
• With Beyond Bond Hair (to schedule your hair appointment, they will need your name and contact).
• With payment processors or technical providers for processing your entry and maintaining our website.
• With legal/regulatory authorities if required (for example, providing winner details to ASA/CAP if requested).
• Data Security: The Promoter will take appropriate technical and organizational measures to protect your data against unauthorised access or disclosure. However, transmission of information via the internet is not completely secure, and any submission of data is at your own risk.
• Data Retention: Personal data of entrants will be retained only for as long as necessary. For non-winners, basic entry data may be kept for a short period after the Competition (to handle any queries or issues, and as required by law) and then securely deleted. Winner’s data may be retained longer to fulfill the prize and for legal record-keeping (e.g. proof of winner for regulatory compliance), but will not be used for other purposes without consent.
• Your Rights: Under UK data protection laws, you have rights such as the right to access the information we hold about you, correct any inaccuracies, or request deletion of your data. Note that deleting data before the Competition ends may void your entry (since we need it to administer the draw). If you have any questions or requests regarding your personal data, you can contact the Promoter at the contact details provided on our website (or via the Contact Us page).
• Privacy Policy: These Terms are to be read in conjunction with Fortune & Favour’s general Privacy Policy (available on our website), which provides more detail on how we handle user data. In the event of any conflict between these Terms and the Privacy Policy solely in relation to Competition data, these Terms will prevail.
By entering, you agree to the processing of your personal information as described above. If you do not agree to this use of your data, please do not enter the Competition.
Amendments and Cancellation
• Right to Amend Terms: The Promoter reserves the right to amend these Terms and Conditions at any time if it becomes necessary to do so. This might occur, for example, to address errors, to ensure compliance with applicable laws or regulatory guidance, or to clarify ambiguous provisions. Any changes to the Terms will be posted on the Competition website page. Where possible and significant, the Promoter will also notify entrants of the changes via the email provided at entry. It is the entrant’s responsibility to review the Terms periodically during the Competition to ensure they are aware of any updates. Continued participation in the Competition will constitute acceptance of any amended terms.
• Cancellation or Suspension: In addition to the Ticket Sales Threshold clause above (which permits cancellation for low entries), the Promoter may cancel, suspend, or void the Competition if unforeseen circumstances make it impossible to continue. This includes, but is not limited to, events like:
• Technical Failures: e.g. if our website is hacked or corrupted, or if a software error results in loss of entry data or unfair process.
• Fraud or Abuse: e.g. if there is evidence of widespread cheating, fraud, or any act undermining the integrity of the Competition that cannot be reasonably remedied.
• Legal Changes: e.g. if a change in law or regulation means the Competition is no longer lawful or requires adjustments that are not feasible.
• Prize Unavailability: e.g. if the prize providers unexpectedly cannot honor the prize and no equivalent substitute can be arranged (outside of the insufficient entries scenario).
• Procedure on Cancellation: If the Competition is canceled before its advertised end date for reasons other than insufficient entries, the Promoter will issue full refunds of the entry fee to all participants, since no prize will have been awarded. If the Competition is suspended or paused, entries already received will be held valid until it resumes or is canceled. The Promoter will communicate any such suspension and subsequent resumption or cancellation clearly on the website and (where feasible) via email to entrants.
• Substitution of Prize: As noted under Prize Details, in the event the specific advertised prize becomes unavailable or impractical for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the prize with an alternative of equal or greater value. The Promoter will endeavour to find a substitute prize that is as close as possible to the original. This substitution right is separate from the “threshold not met” scenario. In a normal prize substitution (not due to low entries), the alternative will be of equal or higher value, so that the winner is not disadvantaged.
• Notification of Changes: Any material changes to the competition (prize changes, date changes, cancellation, etc.) will be communicated on the official website and via the contact information (email) provided by entrants, where available. The Promoter will give as much notice as reasonably practicable in such circumstances.
The Promoter will always strive to run the Competition as advertised. Alterations or cancellations will only be made for valid reasons, and the Promoter will not unreasonably exercise these rights. Entrants agree that the Promoter shall not be liable for any indirect losses or disappointment caused by a modification or cancellation of the Competition in accordance with these Terms.
Governing Law
These Terms and Conditions and any dispute or claim arising out of or in connection with this Competition (including the prize) shall be governed by and construed in accordance with the laws of Scotland and the applicable laws of the United Kingdom. By entering, entrants submit to the jurisdiction of the courts of Scotland for the resolution of any such disputes.
If you are a resident of another part of the UK, you will also retain any rights you have under your local consumer laws, and you may additionally bring an action in your local courts if mandatory law so requires. However, nothing in these Terms shall affect your rights as a consumer to rely on mandatory provisions of local law that apply.
Should any provision of these Terms be held unlawful or unenforceable, that provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full effect. The failure of the Promoter to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.
